  • Illinois is a No-Fault Divorce State: Illinois no longer allows for a fault-based divorce. The only grounds to get divorced in Illinois are irreconcilable differences. You can prove irreconcilable differences with a six-month separation—even if that separation is not physical, meaning you still can live in the same house during the period of separation. 
  • You Must Meet the State’s Residency Requirement: You can get a divorce in Illinois even if you got married in another state. To file in Illinois, you must satisfy the residency standard. Either you or your spouse must have lived in Illinois on a full-time basis for at least 90 days. You should file for divorce in the county of residency.  
  • Divorce May be Uncontested or Contested: An Illinois divorce will fall into one of two broad categories. An uncontested divorce is essentially a “settled” divorce. The parties reached their own settlement on all material issues and the judge is merely signing off on that agreement. A contested divorce refers to divorce litigation. At least one or more issues remain unsettled—meaning the court needs to step in to resolve the matter. Most divorces in Chicago are uncontested—even if the case starts as a difficult dispute.
