Common Family Law Cases

While every family law case is specific to the people and circumstances involved, some of the most common categories include:

  • Divorce, including high-asset divorce and divorce involving other complicating factors
  • Post-divorce modifications
  • Child custody and child support outside of marriage and divorce
  • Paternity
  • Prenuptial and postnuptial agreements

When broken down into its most basic elements, divorce involves the resolution of the following primary terms:

When divorcing spouses are able to negotiate each of these that applies, they don’t require the court’s intervention. As time passes, however, divorce terms that once served exes well can need tweaking, and modifications can be sought. Further, unmarried couples with children can face the need for child custody and child support terms in relation to a breakup.

Paternity issues are also common to family law, and it refers to establishing who a child’s legal father is, which is presumed when the couple is married at the time of the child’s birth. Beyond this, however, paternity must be established. Sometimes, this happens when both parents sign and file the necessary document while in the hospital for the child’s birth. Parents can also, however, take care of this filing after the fact. When parents don’t agree on the matter of paternity, the court can require DNA testing.

Prenuptial and Postnuptial Agreements

Prenuptial agreements are contracts that predetermine how specific divorce terms will be addressed if the marriage does end in divorce. They can also determine inheritances, which is especially common when one or both spouses have children from previous relationships. Prenuptial agreements can resolve the division of marital property and alimony. Because child custody is predicated on the children’s best interests, it cannot be determined ahead of time. Postnuptial agreements can serve the same role as prenuptial agreements. While prenups are created prior to marriage and go into effect upon marriage, postnups are created while the couple is married and go into effect when signed by both parties.
